These Terms and Conditions (“Agreement”) set forth the general terms and conditions of your use of the heyExpat.de website (“Website”) and any of its related products and services (collectively, “Services”). This Agreement is legally binding between you (“User”, “you”, or “your”) and plusForta GmbH (“heyExpat.de”, “we”, “us”, or “our”).
By accessing and using the Website and Services, you acknowledge that you have read, understood, and agree to comply with this Agreement. If you do not agree, you must not use the Website or Services.
1. Accounts and User Data
1.1 To purchase digital products or services, you may be required to provide personal information, including your name and email address.
1.2 You agree that the information provided is accurate, complete, and current.
1.3 We reserve the right to suspend or terminate accounts found to contain false, outdated, or misleading information.

2.1 The Services may include the sale of digital products, such as the Move Planner, Life in Germany Masterclass or Life In Germany Coaching (“Product”).
2.2 In the case of digital content, the statutory right of cancellation shall expire as soon as the execution of the contract has begun with your explicit consent and you have previously confirmed your knowledge of the cancellation of the right of cancellation, § 356 para. 5 BGB (German Civil Code). A refund is excluded thereafter.
2.3 With your purchase of a Service, we grant you a non-exclusive, non-transferable, revocable license to access and use the Product for personal, non-commercial purposes, on a streaming-only basis for that purpose.

2.6 While we do our best to help users achieve the goals and results they desire through our Services, the sole responsibility for results is always with you.
3. Prohibited Activities
You agree not to:

3.5 use another’s account, and not provide another person with the username and password to access your account. In addition, users undertake to protect their own access data against misuse in an appropriate manner.

4.2 Users are granted a limited, personal, and non-commercial license to use the Product; all ownership rights remain with heyExpat.de.

6. Disclaimer of Warranty
6.1 The Website, Services, and Products are provided “as is” and “as available”, without warranties of any kind.
6.2 We do not guarantee that the Services will be error-free, uninterrupted, or always up to date.
6.3 The Product is for informational purposes only and does not constitute individual legal, financial, or immigration advice, nor does it replace professional advice. Users should consult relevant authorities and their websites before making important decisions.
7. Limitation of Liability
7.1 Liability for intent and culpable negligence as well as for damages arising from injury to life, limb or health remains unaffected. Otherwise, liability is limited to typical and foreseeable damages.
7.2 We shall only be liable for damages resulting from the unavailability of services or technical faults if these are due to intentional or grossly negligent behaviour. Temporary, technically-related failures that are beyond our control do not constitute grounds for compensation.

The exemption does not apply if claims are based on intent or gross negligence on the part of heyExpat.de.

11. Dispute Resolution and Governing Law
11.1 This Agreement is governed by and interpreted in accordance with the laws of the Federal Republic of Germany.
11.2 Any disputes shall first be attempted to be resolved through negotiation. If no resolution is reached dispuets with users who are entrepreneurs (Section 14 of the German Civil Code (BGB)), the place of jurisdiction is Düsseldorf. For consumers (Section 13 BGB), the statutory places of jurisdiction apply.
12. Changes and Amendments
12.1 We reserve the right to make changes to these terms and conditions, provided that the changes are reasonable, taking into account the interests of users. You will be informed of changes at least 14 days before they come into effect. If you do not object within this period, the changes will be deemed accepted.
12.2 Changes will be communicated via email or website updates.
12.3 Continued use of the Services after amendments constitutes acceptance of the updated Terms.
